Edupico – Terms of Use

Edupico is an AI-powered exam preparation software solution, designed to help students prepare for the 11+ and related entrance exams. The Edupico platform allows students to practice, access tailored content, track scores, and prepare themselves with interactive learning tools.

These Terms of Use set out the rules on which you can access and use the Edupico website at www.edupico.com, app.edupico.com, and our software platform (collectively, the "Platform").


1. By using the Edupico website and platform you accept these terms

Please read these Terms carefully before you use the Edupico website, app, or software platform, or submit your order to us. If you do not agree to these Terms, you must not use Edupico. We recommend that you print a copy of these Terms for future reference.


2. Other terms that may apply to you

These Terms of Use refer to the following additional terms, which also apply to your use of our website and services:

  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using Edupico, you consent to such processing and you warrant that all data provided by you is accurate.
  • Our Legal Statement, which outlines our copyright and trademark policy.

3. Are you a business customer or a consumer?

In some areas you will have different rights under these Terms of Use depending on whether you are a business or consumer.

You are a consumer if:

  • you are an individual; or
  • you are buying products or services from us wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).

5. Definitions

In these Terms of Use the following terms have the meanings given:

  • "Effective Date" means the date we issue you an email accepting your order for access to the Platform and Licensed Materials.
  • "Information" means any confidential or proprietary documentation, materials, software, code, and information of one Party, disclosed to or obtained by the other Party in connection with these Terms of Use.
  • "Intellectual Property" means all intellectual property rights including patents, trademarks, design rights, copyright, rights in data and databases, domain names, and related goodwill, whether registered or not, subsisting anywhere in the world.
  • "Licensed Materials" means the content available on the Platform which you have purchased access to, including text, information, practice questions, interactive features, images, audio or video materials, performance analytics, and scoring features available through Edupico. Licensed Materials are available online only — no downloadable products are provided.
  • "Parties" means you and us.
  • "Platform" means the Edupico AI-powered exam preparation platform, accessible online and via our app.
  • "Software" means the Edupico software provided as part of the Platform, including updates and modifications.
  • "Subscription Fees" means the subscription fees payable by you to us for User Subscriptions.
  • "Term" has the meaning set out in Clause 18.1.
  • "User Subscriptions" means the subscriptions purchased by you which entitle Users to access the Platform and Licensed Materials.
  • "Users" means the authorised users (students, parents, or teachers) allowed to access Edupico under your subscription.
  • "Virus" means any malicious program or code (including worms, trojans, or viruses) that can harm systems or data.
  • "Working Day" means Monday to Friday, excluding public and bank holidays in England and Wales.
  • "You/Your" means a parent, pupil, teacher, tutor, or other authorised individual who accesses Edupico.

6. Our Contract with You

6.1 We permit use of the Platform and Licensed Materials on the basis of these Terms. By subscribing, you agree to be bound by them.

6.2 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.


7. Licensed Materials

7.1 Subject to your obligations under these Terms, we grant you a non-transferable, non-exclusive licence to access Licensed Materials during your subscription. Licensed Materials are for online use only.

7.2 You must not share Licensed Materials with anyone other than authorised Users.

7.3 All rights in Licensed Materials not expressly granted are reserved by us.

7.4 If we reasonably believe that your use of Licensed Materials infringes third-party rights or breaches law, we may require you to stop using them or replace them with alternatives.


8. Licence to use the Platform

8.1 We grant you a non-exclusive, non-transferable right to use the Platform during your subscription.

8.2 Except as permitted by law, you must not: copy, modify, republish, distribute, reverse-engineer, or build competing products using Edupico.

8.3 You must prevent unauthorised access to Edupico and notify us immediately if you suspect misuse.


9. Users

9.1 Each User Subscription must only be used by one individual.

9.2 Each User must keep their password secure.


10. Provision of the Platform

10.1 We will use reasonable endeavours to make Edupico available 24/7, except during planned or emergency maintenance.

10.2 We do not guarantee uninterrupted or error-free service.

10.3 We do not guarantee that Edupico will be free from Viruses. Users are responsible for securing their devices.


11. Acceptable Use

11.1 You must not upload Viruses or unlawful/abusive content.

11.2 Contributions (messages, forum posts, shared content) must be accurate, respectful, and lawful.

11.3 We may remove contributions or suspend access if these rules are breached.


12. Exercising your right to change your mind if you are a consumer

12.1 Consumers have a legal right to cancel within 14 days of purchase (unless access has already started).

12.2 Once you begin accessing Edupico's Licensed Materials, you lose the right to cancel.


13. Third Party Websites and Internet Use

Links in Edupico may lead to third-party sites. We are not responsible for their content.


14. Warranties

14.1 We warrant that Edupico will be provided with reasonable skill and care.

14.2 We do not warrant that:

  • (a) Edupico will be error-free or uninterrupted;
  • (b) Use of Edupico guarantees success in exams.

15. Your Obligations

15.1 You agree to:

  • (a) use Edupico only for lawful personal/educational purposes;
  • (b) not resell or redistribute Edupico or Licensed Materials;
  • (c) ensure Users comply with these Terms.

16. Charges and Payment

16.1 You must pay subscription fees in accordance with your plan.

16.2 Subscriptions may be monthly or annual.

16.3 Subscriptions auto-renew unless cancelled through the parent portal.

16.4 Subscriptions are non-refundable, except where required by law.


17. Intellectual Property

17.1 All rights in Edupico software, content, and branding remain ours.

17.2 You must not copy, distribute, or share Licensed Materials outside the Platform.


18. Confidentiality

(Clauses unchanged: both parties must keep Information confidential, with standard exceptions like law enforcement requirements.)


19. Liability

19.1 If we fail to comply with these Terms, we are responsible for foreseeable loss/damage caused by us.

19.2 We do not exclude liability for death, injury, or fraud caused by our negligence.

19.3 We are not liable for indirect or business losses, loss of profit, or exam results.


20. Term and Termination

20.1 These Terms continue for the length of your subscription.

20.2 Either party may terminate if the other breaches these Terms.

20.3 On termination, you must stop using Edupico and Licensed Materials immediately.


21. Force Majeure

We are not responsible for failure to perform obligations due to events beyond our control (e.g., strikes, power outages, internet failures, natural disasters).


22. Notices

22.1 Notices must be in writing (post, hand delivery, or email).

22.2 Notices to Edupico should be sent to info@edupico.com.


23. General

23.1 You may not transfer these Terms without our consent.

23.2 Delay in enforcing rights does not mean waiver.

23.3 These Terms are governed by English law, and disputes may be brought in English courts (or Scottish/Northern Irish courts if you live there).
